By accessing or using APIStack ("the Service") operated by APIStack ("we," "our," or "us") at apistack.online, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

APIStack is an API marketplace platform that provides:

• Access to various APIs for integration into your applications
• API testing and development tools
• Usage analytics and monitoring
• Documentation and support resources
• Account management and billing services

The Service is provided on a subscription basis with various pricing tiers and usage limits.

User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Providing accurate, current, and complete information during registration
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Acceptable Use Policy

Payment Terms

Subscription and payment terms:

• Billing Cycle: Subscriptions are billed monthly in advance
• Payment Method: Valid credit card or approved payment method required
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Price Changes: We may modify pricing with 30 days' notice
• Taxes: Prices are exclusive of applicable taxes
• Refunds: Pro-rated refunds for annual subscriptions cancelled within 30 days

All payments are processed securely through Stripe. We do not store your payment information.

Cancellation and Termination

Either party may terminate this agreement:

• User Cancellation: You may cancel your subscription at any time from your dashboard
• Service Continuation: Access continues until the end of your billing period
• Termination for Cause: We may terminate accounts for violation of these Terms
• Data Retention: Account data is retained for 30 days after cancellation
• Effect of Termination: Access to paid features ceases upon termination

Termination does not relieve you of any payment obligations incurred prior to termination.

Intellectual Property Rights

Intellectual property ownership and licenses:

• Service Content: We own all rights to the Service, including software, design, and content
• API License: We grant you a limited, non-exclusive license to use our APIs
• User Content: You retain rights to content you submit or create
• Third-Party APIs: Subject to individual provider terms and licenses
• Feedback: Feedback you provide may be used to improve the Service

You may not copy, modify, distribute, or reverse engineer any part of the Service.

Privacy and Data Protection

Your privacy is important to us:

Service Availability and Support

Service level commitments:

• Third-Party Dependencies: Service may be affected by third-party API providers
• Force Majeure: We are not liable for outages due to circumstances beyond our control

We will provide advance notice of scheduled maintenance when possible.

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless APIStack, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "last updated" date at the top of this page
• Notify users of material changes via email or service notification
• Provide at least 30 days' notice for changes that materially affect your rights

Continued use of the Service after changes constitutes acceptance of the new Terms.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and APIStack regarding the Service and supersede all prior agreements and understandings.
